2. Service Description

UpgradeYou provides an AI-powered career analysis service. You upload your CV/resume as a PDF, and our system generates a personalized career report (PDF format) including market analysis, salary insights, and career development recommendations. The report is a digital product delivered electronically via download.

3. Acceptance of Terms and Eligibility

By using UpgradeYou, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. You must be at least 16 years old to use this service.

4. Account and Authentication

Account creation is handled via Clerk. You are responsible for maintaining the security of your authentication credentials. You must provide accurate information when creating an account.

5. Acceptable Use

You agree to use UpgradeYou only for its intended purpose. You may not:

  • Upload documents that are not your own CV/resume
  • Upload content that is illegal, harmful, or violates third-party rights
  • Attempt to circumvent rate limits, CAPTCHA, or other security measures
  • Use automated tools to scrape or abuse the service
  • Reverse-engineer or attempt to extract the underlying AI models or prompts

6. Payment Terms and Right of Withdrawal

Report purchases are processed through Stripe in Romanian Lei (RON). All prices include VAT. Prices are displayed before purchase.

Career reports are digital content delivered immediately upon purchase. Before completing your payment, you will be asked to expressly consent to immediate delivery and to acknowledge that this means you lose your 14-day right of withdrawal under EU Directive 2011/83/EU (Article 16(m)).

7. AI-Generated Content Disclaimer

Career reports are generated by artificial intelligence and are provided for informational purposes only. They do not constitute professional career advice, financial advice, or employment guarantees. Salary figures, market data, and recommendations are AI-generated estimates and may not be fully accurate. No human reviews the AI output before delivery. You should independently verify any information and make your own career decisions.

8. Intellectual Property

You retain all rights to your uploaded CV/resume. UpgradeYou retains rights to the report format, structure, and the underlying technology. You receive a personal, non-transferable license to use the generated reports for your own career planning purposes.

9. Limitation of Liability

The service is provided “as is” without warranties of any kind, either express or implied. UpgradeYou shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the specific report in question.

10. Termination

We reserve the right to suspend or terminate access to the service for users who violate these terms. You may stop using the service at any time.

11. Governing Law

These terms are governed by the laws of Romania. Any disputes shall be subject to the jurisdiction of the competent courts in Romania.
